The Chapter 7 Process

You then get started on your chapter 7 bankruptcy homework packet, and begin feeling the relief.

Petition Preparation and Review

Complete your chapter 7 Bankruptcy Worksheets and attach the supporting documents, such as paystubs and tax returns. We will prepare your Bankruptcy petition and an experienced Bankruptcy attorney will personally review it with you.

Credit counseling class

Complete your credit counseling class online or over the telephone–you do not physically need to attend a class. This class MUST be completed before your case is filed.

Filing of the Petition

Once we all agree it is accurate and complete, we will file it with the United States Bankruptcy Court. Once the petition is filed, an “automatic stay” goes into effect and the creditors are prohibited from making any attempt to collect their debt, including attempting foreclosure and repossession.

341-Meeting of Creditors

One of our attorneys will accompany you at your 341 Meeting of Creditors, where you will be examined by a trustee. Most 341 hearings last less than 5 to 10 minutes.

Discharge

Your Notice of Bankruptcy Discharge will usually come in the mail within three to four months of the conclusion of the 341 meeting.

The Chapter 13 Process

Filing for Chapter 13 Bankruptcy is no walk in the park and generally should not be attempted without experienced legal counsel. There are many nuances between district courts, judges and trustees. With that in mind, here’s how it works in a nutshell:

Once we all agree it is accurate and complete, we will file it with the United States Bankruptcy Court. All creditor activities are legally stopped!

341-Meeting of Creditors

Our Chapter 13 Bankruptcy Attorney will accompany you at your 341 Meeting of Creditors. A Chapter 13 341 meeting is very in depth and personal. However, there is no reason to worry as we will work with you to prepare you for the Meeting of Creditors.

Confirmation Hearing

If you are required to attend a “Confirmation Hearing” we will let you know. Either way, we will keep you advised every step of the way.

The Chapter 13 Plan

Continue to make the monthly Chapter 13 Plan Payment for the duration of the bankruptcy case. If you own real estate and/or choose to make vehicle payments outside for the plan you will need to continue to make your regular monthly mortgage and/or vehicle payments as well. We can elect to make car payments through the plan, or outside the plan, depending upon your best interests. We will need to submit annual tax returns to the chapter 13 trustee for the duration of the plan.

Complete the Plan and Receive Your Discharge

Once your plan is complete, three (3) to five (5) years later depending on the plan, the Bankruptcy Court will issue your Discharge.
